What is Lasting Powers of Attorney?

A Lasting Power of Attorney is a legal document that allows you to give authority to someone else to act on your behalf. It must be on a specific form and registered with the Office of the Public Guardian (OPG) before it can be used.


There are two types:
Property & Financial Affairs - Your attorneys can take care of financial decisions for you. This includes communicating with banks, government agencies and financial
organisations, paying bills, and deciding what happens to a property.

Health & Welfare - Your attorneys can make decisions around care and residence, and ongoing or life sustaining treatment.


If you have an accident or become ill, your loved ones do NOT have the legal authority to deal with your finances or make decisions about your care, so putting LPAs in place
is critical.

Making an LPA can be complex and really should be done with help and advice. There are lengthy forms to complete, and signatures be must gathered in the right order. A simple mistake could mean rejection and repayment of OPG fees.


Careful consideration is also needed in choosing the right people and how and when you want them to act.


Making sure your LPAs work in the future, with specific wordings and clauses, can also save time and cost. Our fixed fee service includes personalised advice and acting as your “certifier” (confirming your capacity to make your LPA).

 

We prepare the forms, collect all the required signatures and submit them to the OPG on your behalf, then keep you updated about
their progress.


After registration, we send you the final registered documents, plus a copy, for safe-keeping.

Why Do I Need an LPA?

Did you know your next of kin doesn’t automatically have a legal right to deal with your affairs, or make decisions for you, if you can no longer do this yourself?


If an accident or illness leaves you unable to communicate your own decisions, would you want these to be made by someone you trust, rather than by a stranger, or by a care provider if you need long term care?


Would you like to give those you love and trust the legal authority to assist you and make decisions for you as needed in the future?


You can only make an LPA when you have the capacity to do so. If the worst happens and you don’t have an LPA in place, your family would have to apply to court for deputyship - a lengthy, costly process.

How Much Does it Cost?

Our service is very affordable as we believe finance shouldn’t stop you being protected.

Either Finance OR Health LPA

Single £300, couple £450.

Both Finance AND Health LPAs:

Single £450, couple £750.

There is an additional OPG registration fee of £82 per LPA, unless you are exempt.
